Terms and Conditions
- Competition Period: The ‘Win a Fonz Moto Scooter by taking part in Challenge 60 this Earth Hour’ Competition Giveaway (“Promotion”) commences on 17 January 2025 at 10.00 am AEST and final entries close on 31 March 2025 at 11.59 pm AEST (“Promotional Period”).
- Promoter & Supplier: The Promoter is the World Wide Fund for Nature Australia (ABN 57 001 594 074) of Suite 3.01, Level 3, 45 Clarence Street, Sydney NSW 2000 (“WWF-Australia” or “Promoter”). The Promotion is conducted by the Promoter with the support of its partner, Fonz Moto Pty Ltd (ABN 69 146 454 113) of 9/37 O'Riordan Street, Alexandria 2015 (“Partner” or “Supplier”).
- Entry eligibility:
- Entry is only open to Australian residents aged 18 years or over.
- The directors and employees from the Promotor, Supplier or other entities associated with this Promotion and their immediate families are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
- Incomplete or indecipherable entries will be deemed invalid. Entries automatically generated by computer, completed by third parties other than the Promoter’s service provider in bulk, or that have been altered, reconstructed or tampered with will be rejected.
- Agreement to Rules:
- By entering the Competition, the entrant of the Competition (“You” or “Entrant”) agrees to comply with and abide by these Terms & Conditions and the decisions of the Promoter, and you represent and warrant that you meet the eligibility requirements. Information on how to enter and the prizes form part of these Terms and Conditions.
- In addition, you agree to accept the Promoter's decisions as final and binding as those decisions relate to the content of this campaign.
- Collection and use of personal information:
- Personal Information including your name, address, telephone number and email will be collected and used for the purpose of conducting this Competition. This may, for this purpose, require disclosure of such information to Supplier and other third parties, including, but not limited to, agents, contractors, service providers, Promotion suppliers and as required, to Australian regulatory authorities. Validity of an entry is conditional on providing this information.
- Any personal information provided will be managed in accordance with WWF-Australia’s Privacy Policy which can be accessed at http://www.wwf.org.au/privacy-policy.
- In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, subject to your explicit consent, for an indefinite period, unless otherwise advised, use your personal information for promotional, fundraising, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning you, in accordance with any applicable Laws.
- Entry Instructions: To enter the Promotion, you must undertake the following steps during the Promotional Period:
- Visit the Promoter’s web page www.earthhour.org.au/event/challenge60 and sign up for Challenge 60 by inputting the requested information including your full name and email address and opt in to the ‘Win a Fonz Moto Scooter by taking part in Challenge 60 this Earth Hour’ Competition.
- No fees will be charged for entering the Promotion. However, any cost associated with accessing the Promoter's website for the purpose of entering this Promotion is your responsibility and is dependent on the internet service provider used. You are responsible for any and all other expenses that may incur in entering or winning the competition.
- In additional to clause 6a, you will receive one (1) additional entry into the Promotion if you complete one of the below actions related to your participation in the Promotion (“Eligible Action”):

- Log First Hour of activity to your fundraising page;
- Share fundraising page via social media or email;
- Received the first donation from a third party to your fundraising page;
- Make a self-donation for any amount;
- Create a team page;
- Raised $250;
- Reached Your Fundraising Goal;
- Raised $500;
- Completed and logged 22 hours of activity (22 x 60mins);

- The additional entry can be accrued by completing different types of Eligible Actions. A maximum of ten (10) additional entries will be accrued if you complete all ten types of Eligible Actions listed above.
The winner will be selected based on a game of luck, with one (1) entry drawn at random from all eligible entries received during the competition period. For the avoidance of doubt, the Promotion is not skill-based, and the outcome is purely determined by chance.
If there is a dispute as to your identity, the Promoter reserves the right, in its sole discretion, to determine the identity.
8.Prize:
The Prize will be ONE Fonz Moto scooter (a Fonz Moto Cuban Green Arthur 7 model with sand saddle combo) (“Prize”). The maximum value of the Prize is $8,290 including GST.
The Prize is supplied by the Supplier.- If the winner’s postal address is in any Australian capital city, the Prize will be delivered to the winner by the Supplier. Otherwise, it will be the responsibility of the winner to either collect the scooter from the Supplier’s Showroom at Unit 9/37 O'Riordan St, Alexandria NSW 2015, or pay for the delivery costs.
- The Prize is not transferable or exchangeable and cannot be taken as cash.
- The Supplier reserves the right to replace the Prize with an alternative Prize of equal value if circumstances beyond the Supplier’s control make it necessary to do so. The Promoter will not be responsible for any changes to the Prize that are made by the Supplier.
- The Promoter’s decision is final as to the winner, and no correspondence will be entered into.
- The winner must comply with all relevant legal requirements that relate to the use and ownership of the Prize, including but not limited to relevant registration, licensing and safety (including wearing necessary protective gear). Licencing requirements vary between state/territory jurisdictions. It is the sole responsibility of the winner to understand the requirements to legally and safely drive the Prize.
- The Promoter is not liable for any expenses associated with the Prize including but not limited to licencing, insurance, helmets and other protective gear.
- The Promoter and the Supplier are not liable for any death or personal injury, medical expenses, loss of income or any other expenses whatsoever caused by, arising from or associated with use of the Prize.
- If you are selected as the winner, you will be notified at or by the Promoter sending a winner written notification by email to the email address the winner (“Winner Notification Email”) before 5.30pm AEST within 7 days of the draw. The winner’s details (first initial, last name and postcode) will be published on the WWF-Australia Earth Hour website at https://www.earthhour.org.au/event/challenge60/win, and will remain on the website for a minimum of 90 days.
- The winner must claim the Prize by replying to the Winner Notification Email within 60 days of the date the Promoter transmits the Winner Notification Email.
- As condition of accepting the Prize, the winner must provide all details reasonably required by the Promoter and the Supplier and facilitate taking possession of the Prize, including but not limited to providing personal information, and signing any legal documentation as and in the form required by the Promoter and/or Supplier in their absolute discretion.
- If the winner does not claim the Prize in accordance with clause 9b, the Prize will be deemed unclaimed and it will be redrawn on 15 July 2025 at 10:00 am AEST at Suite 3.01, Level 3, 45 Clarence Street, Sydney NSW 2000.
- The winner of the redraw will be notified by 5.30pm AEST by 21 July 2025 by the Promoter sending a written redraw Winner Notification Email to the email address provided by the winner. The redraw winner’s details (first initial, last name and postcode) will be published on the WWF-Australia Earth Hour website at www.earthhour.org.au/get-involved/win and will remain on the website for a minimum of 90 days.
- The redraw winner must claim the Prize by replying to the Winner Notification Email within 60 days of the date the Promoter transmits the Winner Notification Email. The redraw winner must provide all details reasonably required by the Promoter and the Supplier and facilitate taking possession of the Prize, including but not limited to providing personal information, and sign any legal documentation as and in the form required by the Promoter and/or Supplier in their absolute discretion, such as a legal release and indemnity form.
- If the redrew winner does not claim the Prize in accordance with clause 9b, the Prize will be deemed unclaimed and it will be redrawn on 29 September 2025 at 10:00 am AEST at Suite 3.01, Level 3, 45 Clarence Street, Sydney NSW 2000.
- The winner of the further redraw will be notified by 5.30pm AEST by 6 October 2025 by the Promoter sending a redraw Winner Notification Email to the email address and/or calling the telephone number provided by the winner. The redraw winner’s details (first initial, last name and postcode) will be published on the WWF-Australia Earth Hour website at www.earthhour.org.au/get-involved/win and will remain on the website for a minimum of 90 days.
- The further redraw winner must claim the Prize by replying to the Winner Notification Email within 60 days of the date the Promoter transmits the Winner Notification Email. The redraw winner must provide all details reasonably required by the Promoter and the Supplier and facilitate taking possession of the Prize, including but not limited to providing personal information, and sign any legal documentation as and in the form required by the Promoter and/or Supplier in their absolute discretion, such as a legal release and indemnity form.
- If the further redraw winner does not claim the Prize in accordance with clause 10b, the Prize will be deemed unclaimed and it will be redrawn for the third time on 28 November 2025 at 10:00 am AEST at Suite 3.01, Level 3, 45 Clarence Street, Sydney NSW 2000, and the process identified in clauses 10f (with appropriate changes of date) followed. If there is no response to the redraw in this clause, the Provider will give notice and seek advice for disposal of prizes.
- You consent to the Promoter using your name, likeness, image and/or voice in the event your are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including the fact that the winner was successful), and promoting any products manufactured, distributed and/or supplied by the Promoter and the Supplier, and the mission and activities of the Promoter.
- Subject to relevant regulatory approval, the Promoter may withdraw this Promotion, vary the Prize or otherwise amend these Terms and Conditions at any time. Without limitation to the foregoing, if the Prize becomes unavailable, including because of delays associated with identifying the winner, the Promoter may substitute the Prize with a Prize of equal value.
- The Promoter reserves the right, at any time, to verify the validity of entries and Entrant (including your identity, age and place of residence) and to disqualify anyone who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
- to disqualify any Entrant; or
- subject to relevant regulatory approval, to modify, suspend, terminate or cancel the Promotion.
- The Promoter makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Promotion.
12.Liability
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”).
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including but not limited to:
- any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
- any theft, unauthorised access or third-party interference;
- any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
- any variation in Prize value to that stated in these Terms and Conditions;
- any tax liability incurred by you; or
- taking and/or use of the Prize.
13. Jurisdiction: This agreement is governed by the law in force in the relevant jurisdiction.
14.Dispute Resolution: Any dispute arising in connection with these Terms and Conditions or in connection with the Promoter which cannot be resolved by good faith negotiations between you and the Promoter may be referred to mediation or to arbitration. However, the Promoter reserves, at its absolute discretion, the right to instigate legal proceedings prior to negotiation, arbitration or mediation against any individual, organisation or entity, who in the Promoter’s opinion has acted in breach of these Terms and Conditions.
